Labour contract appendix: what it can change and what it cannot

8 sectionsAbout 4 min readUpdated 01/10/2026

A labour contract appendix (phụ lục hợp đồng lao động) is the simplest way to change a salary or a job title, or to add a place of work, without re-signing the whole contract. It is also a document that is often misused: the contract term is extended through an appendix, the appendix is printed in advance and simply handed to the employee to sign, or the number of the original contract is left out. This article sets out what an appendix may change under Article 22 of the Labour Code 2019 (Bộ luật Lao động 2019) and what to check before signing.

What a labour contract appendix is and what legal weight it carries

Under Article 22 of the Labour Code 2019, an appendix forms part of the labour contract and has the same effect as the contract. An appendix does one of two things: it sets out the detail of a term the contract already contains, such as a sales employee's targets and commission formula, or it amends or supplements a term already signed, such as the salary, department or place of work. Because it is part of the contract, an appendix must be signed by both parties and kept with the original contract; a pay rise notice from HR or an email confirming a change of department cannot take its place.

When to sign an appendix and when a new contract is needed

Sign an appendix when the original contract is still in force and only a few terms change: a payments accountant whose salary rises from 12 million to 13.5 million VND after a performance review, a marketing specialist moving from the Hanoi branch to the Ho Chi Minh City office, a technician promoted to team leader with a responsibility allowance. Sign a new contract when the contract has expired, when the type of contract changes, or when the same person already has three or four overlapping appendices; consolidating them into one new contract makes the file easier to check during an inspection or when insurance contributions are reconciled.

What an appendix must state to avoid being misread

A complete appendix has four parts: a reference to the original contract by number and signing date; the amended terms, written as pairs of old and new; the effective date; and a statement that all other terms remain unchanged. The template on Việc Hot follows exactly this order in three articles: grounds for the amendment, amended and supplementary terms, and entry into effect.

A salary amendment clause written the right way

Article 1. The two parties agree to amend Article 4 of Labour Contract No. 027/2025/HDLD signed on 3 March 2025 as follows: old salary 12,000,000 VND/month; new salary 13,500,000 VND/month, applicable from the October 2026 pay period.

Article 2. This appendix takes effect from 1 October 2026 and forms an integral part of the labour contract. All other terms of the contract remain unchanged.

Write both the old and the new amount, so that anyone reading the appendix later does not have to dig out the original contract, and so that if the old amount is wrong, both sides notice it at the moment of signing.

What employees should check before signing an appendix

  • The contract number and signing date on the appendix match the copy of the contract you hold.
  • The new salary is not lower than the old one; if it is lower, there must be a reason, and you have the right not to sign.
  • The effective date is clear and is not backdated to your disadvantage.
  • The appendix contains no "extension" and no new end date; if it does, ask for a new contract instead.
  • You receive a copy bearing the company's signature and seal.

Common employer mistakes with contract appendices

The most common is using an appendix to "extend by another 12 months"; in a dispute, the extension is not recognised and the employment relationship may be treated as having become indefinite-term. The second is raising pay through an appendix without adjusting the social insurance contribution, which leads to the shortfall being collected retrospectively. The third is appendices with no number and no effective date, with so many overlapping versions that HR no longer knows the current salary. To prevent this, give each appendix a sequence number, change one group of terms at a time and file it next to the original contract.

Drafting a labour contract appendix on Việc Hot

  1. Choose the appendix template and the industry

Choose an industry so that the template gains industry-specific clauses: sales gets targets and commission, IT gets ownership of source code.

  2. Fill in both parties and the amended terms

Enter the original contract number, job title, place of work and new salary. Turn on "View by role" to read the notes for each side.

  3. Check, then print or save

The "Notes and checks" tab flags any fields that are still empty. The printed copy contains no notes; the appendix is saved in your account.

Frequently asked questions

An appendix needs the signatures of the legal representative or an authorised person and of the employee. If the business uses a seal, it stamps the appendix just as it did the original contract.

No. Article 22 of the Labour Code 2019 does not allow an appendix to change the contract term. If you want to keep working after the term ends, sign a new contract within 30 days.

The law sets no limit. Once there are many overlapping appendices, the two sides should sign a new contract to replace them so that everything is easy to check.

The original contract remains in force at the old salary. The company may not cut pay on its own without an appendix signed by both sides.
