Maternity pay 2026: 6 months' salary, 5,060,000 VND per child and post-birth recovery pay

Maternity pay is more than the salary for the months of maternity leave. An experienced HR person will remind you to count all three payments: 6 months of leave paid at 100% of your average insured salary, a one-off allowance of 2 times the reference level (mức tham chiếu) for each child, and recovery pay if you return to work before your health has fully recovered. This article works out each payment at the rates from 1 July 2026, together with the 6-month contribution condition, the husband's entitlements and the documents to submit.

Eligibility for maternity benefits: 6 months of contributions in the 12 months before birth

Under the Social Insurance Law 2024 (Luật Bảo hiểm xã hội 2024), a female employee who gives birth is entitled to maternity benefits if she has paid social insurance for at least 6 months in the 12 months before the birth. These 6 months need not be consecutive or with the same company; a change of job along the way still counts, as long as there are 6 months of contributions within the 12 months immediately before the birth. For women who must take pregnancy rest on the instruction of a medical facility, the condition drops to 3 months in the 12 months before the birth, provided they already have at least 12 months of contributions.

The detail most often overlooked is probation. If probation is under a separate contract and the company has not paid insurance, those months do not count. An accountant who started in March, did two months' probation, had insurance paid from May and gave birth in early November has exactly 6 months of contributions, just enough; a birth one month earlier would fall short.

The three maternity payments and how each is calculated

  1. 6-month average salaryBefore maternity leave
  2. Multiply by months of leave6 months, 7 for twins
  3. Plus the one-off allowance5,060,000 per child
  4. Plus recovery pay759,000 per day
  5. Total maternity payTax-free

The largest payment covers the months of maternity leave: each month equals 100% of the average social insurance contribution salary for the 6 months immediately before leave, paid by the insurance fund in place of salary. The contribution salary is capped at 20 times the reference level, which is 50,600,000 VND from 1 July 2026, so a month of maternity pay cannot exceed that amount either.

The second is the one-off childbirth allowance of 2 times the reference level for each child: 5,060,000 VND at the reference level of 2,530,000 VND that applies from 1 July 2026, or 10,120,000 VND for twins. The third is post-birth recovery pay: if you return to work before your health has recovered, you can take 5 to 10 more days off depending on the case, paid at 30% of the reference level per day, which is 759,000 VND. Many people miss this payment because they have to ask the company for it themselves.

Assumptions: birth on or after 1 July 2026, reference level 2,530,000 VND; the average salary is the average social insurance contribution salary for the 6 months immediately before leave.

None of these payments is subject to personal income tax, so the figures in the table are what reaches your account. The 6-month average salary before leave is the decisive figure: if the company registers a contribution salary lower than your real salary, this is exactly when you lose out. The husband's entitlements when his wife gives birth

A husband who is paying social insurance can take leave on maternity benefit when his wife gives birth, with the number of days depending on the type of birth, and the insurance fund pays for those days based on his contribution salary. The days are taken within the initial period after the birth, as set by current regulations. If only the husband is insured, he may receive the one-off childbirth allowance under separate conditions in the law.

Maternity benefit documents submitted through the company

If you are employed, you submit the documents to HR; the company prepares a list for the Social Insurance Agency and the money goes straight into your account. Under current rules, someone who left their job before the birth but still meets the contribution condition files directly with the Social Insurance Agency office where they live.

  • A copy of the child's birth certificate (giấy khai sinh) or the hospital's certificate of birth (giấy chứng sinh).
  • A document from the medical facility confirming a caesarean birth or a birth before 32 weeks, if the husband applies for 7 days of leave.
  • A certificate of prescribed pregnancy rest, if you rely on the condition of 3 months of contributions in 12 months.
  • A request on the company's form, stating the leave start date and the bank account for the payment.

Example wording for a maternity leave request

My baby is due around 15 November 2026, and I would like to take maternity leave from 1 November 2026 to 30 April 2027 inclusive. During my leave, my accounts payable work will be handed over to Ms Nguyễn Thị Lan. I will submit a copy of my child's birth certificate to HR as soon as the paperwork is done.

Common mistakes when calculating maternity pay

  • Entering take-home pay or pay including bonuses in the calculator; the correct figure is the average social insurance contribution salary for the 6 months immediately before leave.
  • Counting the total contribution period instead of the months contributed in the 12 months before the birth; someone with 5 years of contributions and a gap just before the birth may still not have 6 months.
  • Forgetting the one-off childbirth allowance and recovery pay, or using the old reference level of 2,340,000 VND for a birth after 1 July 2026.
  • Assuming maternity pay is reduced by personal income tax or insurance deductions, and underestimating it as a result.
  • Not agreeing the leave start date with the company, so that the timesheet and the file sent to the Social Insurance Agency do not match.

If you are still negotiating your contract, pay attention to the clause on the insurance contribution salary in the labour contract: maternity, sickness and unemployment benefits later on are all based on that figure, not on bonuses or allowances outside the contract.

Frequently asked questions

For one child born on or after 1 July 2026, you receive 120,000,000 VND for 6 months of maternity leave plus a one-off allowance of 5,060,000 VND, a total of 125,060,000 VND, not counting recovery pay if you take extra days off. None of this is subject to personal income tax.

You do not meet the condition of 6 months of contributions in the 12 months before the birth, so you are not entitled to maternity leave pay or the one-off allowance. The exception is a woman who must take prescribed pregnancy rest: she needs only 3 months in the 12 months before the birth, but must have at least 12 months of contributions.

No. Maternity leave pay, the one-off childbirth allowance and recovery pay are all benefits from the social insurance fund; they are not counted as taxable income and no insurance contributions are deducted from them.

The leave is 7 months, because each child from the second onwards adds 1 month. The one-off allowance is 2 times the reference level for each child, which comes to 10,120,000 VND from 1 July 2026, and the husband gets 10 days of leave, or 14 days if surgery is needed.
