Piecework contracts: paid on accepted volume, no timekeeping, and when it becomes employment

7 sectionsAbout 4 min readUpdated 01/10/2026

A piecework contract (hợp đồng khoán việc) hands over a complete volume of work and pays for the result: repainting 400 m2 of wall, entering 5,000 rows of data, translating 120 pages of documents. The Việc Hot template is based on the Civil Code, not the Labour Code, and that single point shapes both how it is drafted and what the risks are. This article explains when work can be contracted out this way, which clauses must be watertight, and when a piecework contract is treated as a labour contract.

What a piecework contract is and when it can be used

The template cites Article 542 of the Civil Code 2015 (Bộ luật Dân sự 2015) on processing contracts, a close relative of the service contract in Article 513: one party undertakes to produce a result and the other pays for that result. The contractor organises their own labour and tools and is responsible for the safety of the people they deploy; the contracting party hands over the site and documents and carries out acceptance on schedule. Piecework is appropriate when the work stands apart from day-to-day operations, can be measured by volume and has an end point: a crew of painters taking on a three-storey office building in 20 days, an individual entering data from old medical records, a translation team handling 120 pages of technical documents at a per-page rate. Recurring daily work such as security, cleaning, accounting or warehouse jobs cannot be contracted out as piecework; that is a labour contract.

When a piecework contract is treated as a labour contract

Article 13 of the Labour Code 2019 (Bộ luật Lao động 2019): an agreement under a different name that involves paid work and management, direction and supervision by one party is a labour contract. "Piecework" is the most abused word in construction and manufacturing. A worker who puts in 26 days a month at the factory, has attendance recorded by a team leader, and is paid per piece but on the 10th of every month with an attendance bonus is on a labour contract with piece-rate pay, and insurance must be paid from one full month under the Social Insurance Law 2024 (Luật Bảo hiểm xã hội 2024).

Clauses that must be watertight in a piecework contract

Piecework disputes are almost always about acceptance and payment. The volume must be stated in measurable units: m2, pages, sets, rows. Acceptance standards must be specific: two coats of paint, no runs, no base showing through; a translation that follows the attached glossary. The schedule needs interim milestones, each with an acceptance record, and payment follows the records.

  1. Sign the contractFix the volume, unit price, acceptance standards and advance payment
  2. AdvancePart of the value to buy materials, with the amount and transfer date stated
  3. Staged acceptanceA record signed by both parties, with payment per stage
  4. Final acceptanceSettle the balance, hand back the site and the records

A correctly worded contract value and payment clause

Article 3. Contract value and payment: Contract value: 96,000,000 VND (In words: ninety-six million dong), based on a unit price of 240,000 VND/m2 for 400 m2 of wall, including materials and labour. Party A pays an advance of 30% within 3 working days of signing; 40% after acceptance of floors 1 and 2; and the remaining 30% within 5 working days of signing the final acceptance record.

What the contractor should check before signing

  • The volume and unit price are given as figures with a total value, and it is clear how work beyond the agreed volume will be priced.
  • Whether there is an advance, what percentage and when it is paid; do not accept "paid in one go when finished" for work lasting several weeks.
  • Specific acceptance standards, who carries out acceptance and within how many days they must respond, and whether silence past the deadline counts as acceptance.
  • Which party supplies materials, tools and protective equipment, and which party buys accident insurance for the workers.
  • The personal income tax withheld at source if the contractor is an individual, so you know what you will actually receive.
  • If you work by the hour, have your attendance tracked and are directed day to day, ask for a labour contract instead of a piecework contract.

Common employer mistakes with piecework

  • Using piecework contracts for year-round positions such as security guards, cleaners or machine operators to avoid paying insurance.
  • Writing fixed working hours and attendance tracking into the piecework contract, which creates evidence of an employment relationship.
  • Describing the volume vaguely, such as "complete the interior of floor 2", with no unit of measurement and no acceptance standards.
  • Not drawing up acceptance records at each stage, then arguing about the volume at the end.
  • Not stating who is responsible for safety and protective equipment when a crew works on a construction site.
  • Not withholding personal income tax when paying an individual contractor.

Drafting a piecework contract on Việc Hot

Click "Use this template" and choose an industry to get its specific clauses: construction and real estate adds sections on working on site and construction safety, information technology adds ownership of the work product. Fill in both parties, the volume of work, the location, the timeframe and the contract value; add the advance and the payment milestones directly in the value clause. The editor alerts you if you enter fixed working hours in a piecework contract. Once finished, print it directly, save it in your account or send the contractor a link.

Frequently asked questions

Genuine piecework is a civil contract and is not subject to compulsory insurance. If the contractor works by the hour, has attendance tracked and is directed like an employee, then under Article 13 of the Labour Code it is a labour contract and insurance must be paid from one full month.

Yes. Payments to an individual contractor are subject to personal income tax withheld at source under current regulations; the two parties should state clearly whether the contract value includes or excludes this tax.

It depends on the scale, but for work lasting several weeks there should be an advance, staged payments after each acceptance record, and a portion held back until final acceptance.

Both are civil contracts. Piecework focuses on a specific volume and a result that can be accepted, and the Việc Hot template cites Article 542 on processing; a service contract is used for work provided over time or as a package and cites Articles 513 to 521.
