Internship contracts for students: how they differ from probation, insurance and allowances

7 sectionsAbout 4 min readUpdated 01/10/2026

An internship contract is an agreement between a business and a student who comes to gain practical experience for a short period, usually as part of their course. It is not a probation contract, still less a labour contract, yet many companies use interns as cheap staff and many students sign without knowing what they are entitled to. This article distinguishes three documents that are often confused, sets out the clauses an internship contract must have and explains how to draft the template on Việc Hot.

How an internship contract differs from probation and from a labour contract

The Việc Hot template cites the Labour Code 2019 (Bộ luật Lao động 2019) and the training institution's internship rules as its basis, and calls the two parties the Host organisation and the Intern. An intern comes to learn through real work, with a supervisor and an evaluation sent back to the school; the goal is an internship report, not a sales target. Probation is the first step of an employment relationship, with pay of at least 85% and a maximum of 60 days for work requiring a college degree or higher under Articles 25 and 26. A labour contract means paid work, under management, with insurance.

When interns work like employees: Article 13 again

Article 13 of the Labour Code treats any agreement involving paid work together with management, direction and supervision as a labour contract, whatever it is called. An "intern" who works 8 hours a day, clocks in, chases targets, covers the counter for absent staff and receives 4 million VND a month described as an "allowance" shows every sign of employment. In that case the company must sign a labour contract, pay no less than the regional minimum wage, which is 5,310,000 VND in Region I from 1 January 2026 under Decree 293/2025/ND-CP, and pay insurance from one full month. A healthy internship means being given work in order to learn, with someone to guide you and feedback on the results, no deductions for lateness and no sales targets to carry. A business that wants to use final-year students' labour outside class hours should use a part-time labour contract; Article 32 gives part-time employees pay, rights and obligations equal to those of full-time employees.

Clauses an internship contract must have

The template has five blocks: the internship content, with position, department, tasks and location; the internship period and attendance times; the expense allowance; supervision and evaluation responsibilities; and confidentiality. Fill them in with real details: the supervisor's name, the attendance schedule by day and hour, what the intern will learn, such as which software they will use and which projects they will join, how the end-of-term evaluation is done on the school's form, and the allowance amount and payment date. The template also points out two things: an intern is not yet an employee, so social insurance is not compulsory, and the allowance may still be subject to personal income tax withholding under current regulations.

Correctly worded period and allowance clauses

Article 2. Internship period: From 5 January 2027 to 31 March 2027. Attendance: Monday, Wednesday and Friday, from 8:00 to 12:00, in the Marketing department.

Article 3. Expense allowance: Allowance: 2,000,000 VND/month (In words: two million dong), covering lunch and travel, paid on the 5th of the following month.

What students should check before signing an internship contract

  • The supervisor's name and a specific department; an internship in a "general office" with nobody guiding you usually means running errands.
  • Attendance times with clear days and hours, so they do not clash with classes and you are not called in for 8 hours a day.
  • The allowance written as a figure, the payment date, and whether personal income tax is withheld.
  • The company undertakes to write an evaluation and confirm your results on the school's form before the report deadline.
  • The confidentiality clause covers only information accessed during the internship and does not stop you from working for another company later.
  • No handing over original diplomas, no payments; if you are given work like an employee, ask for a part-time labour contract.

Common employer mistakes with interns

  • Using interns in place of staff: tracking attendance, setting targets, rostering shifts and paying a monthly "allowance" like a salary.
  • No supervisor, no learning content, and no evaluation for the school at the end.
  • Not stating attendance times, then requiring the intern to work a full 8 hours a day.
  • Giving interns access to customer data without a confidentiality clause.
  • Keeping original transcripts or diplomas, or charging an "internship fee".
  • Taking people on to learn a trade so that they can later work for the business, but calling it an internship and not signing a vocational training contract under Articles 61 and 62.

Drafting an internship contract on Việc Hot

Click "Use this template" and choose an industry to get its specific clauses: education and training has sections on learning materials and conduct towards learners, information technology has ownership of work product and work accounts. Fill in the host organisation; the intern's full name, citizen ID card and place of residence; and the position, department, content, location, period, attendance hours and allowance. The finished contract can be printed directly, saved as a template for the next intake, or printed in a bilingual version for international students. If the intern does well and you want to keep them, move on to the probation template or a definite-term labour contract.

Frequently asked questions

No, because a genuine internship is not yet an employment relationship. But if an intern works office hours, has attendance tracked and receives monthly payments like a salary, then under Article 13 of the Labour Code it is a labour contract, and insurance must be paid from one full month.

The law sets no allowance for interns; whether there is one and how much is a matter of agreement and should be stated clearly in the contract. The allowance may still be subject to personal income tax withholding under current regulations.

Yes. If the company wants a further trial, the probation period is still subject to the caps in Article 25, with pay of at least 85%; if it is confident enough, it can go straight to a definite-term labour contract.

No. The letter of introduction is the school's own procedure; the internship contract is an agreement between you and the business on content, timing, allowance and evaluation. Many schools require both.
