Remote work contract template: how to cover location, contact hours and equipment

8 sectionsAbout 4 min readUpdated 01/10/2026

A developer in Da Nang working for a Hanoi company, an accountant who works from home three days a week: remote work has become an ordinary way of organising work. What has not changed is the law. A remote work contract (hợp đồng làm việc từ xa) must still state the place of work, working hours, pay and insurance like any labour contract, and it needs three further items that templates often leave out: contact hours, equipment and data security, and the schedule for attending the office.

Remote work is still a full labour contract

The Labour Code 2019 (Bộ luật Lao động 2019) has no separate form for remote work, and it does not need one. Article 13 looks only at the substance: if there is pay together with management, direction and supervision, it is a labour contract, whether the person sits in an office or at home. Remote workers therefore have full annual leave, public holidays, compulsory insurance for contracts of 1 full month or more, and the right to terminate unilaterally with 45, 30 or 3 days' notice depending on the type of contract. The difference lies in Article 21: the place of work is a mandatory core term, and the way it is worded decides almost every dispute that follows.

How to state the place of work for remote work

Give the exact address where the employee mainly works, usually their home, together with the head office address for days when they need to be there. For hybrid work, state the number of days per week at each location. The phrase "as assigned by the company" is not enough: the editor flags a missing place of work when this field is empty.

A place and manner of work clause written the right way

Article 3. The employee works mainly at a location away from the head office: 12 Le Loi Street, Hai Chau Ward, Da Nang City. The employee attends the company's head office in Hanoi for no more than 2 days a month, according to a schedule notified at least 3 working days in advance; travel and accommodation costs are paid by the company under its internal regulations.

A permanent move to working at the head office may only be made once both parties have signed a contract appendix.

Working hours and contact hours

The limits of 8 hours a day and 48 hours a week under Article 105 apply in full to remote workers. The problem is not the numbers but how time is measured: without a time clock, the two sides need to agree on the hours when the employee must be online, for example 09:00 to 12:00 and 13:30 to 17:30, how the start and end of the working day are reported, and the official channel for receiving tasks. A message at 22:00 assigning work that must be dealt with straight away is overtime, which requires agreement and overtime pay.

Equipment, internet costs and data security

The template has a field for the equipment and internet allowance. The business chooses one of two approaches: provide a computer, headset and security key with a handover record, so they can be recovered when the contract ends; or let the employee use their own computer and pay a fixed monthly allowance that also covers the internet. The confidentiality clause must state clearly that customer data, source code and internal documents may not be stored outside the company's systems and must all be handed back on leaving. The detailed confidentiality terms are best set out in a separate non-disclosure agreement signed alongside the contract under Article 21(2).

What employees should check before signing

  • The place of work is a specific address, with the maximum frequency of office attendance and who pays the travel costs.
  • The online hours and the official channel for assigning work are stated; anything outside those hours is overtime.
  • Who provides the equipment, how much the allowance is, and how equipment is handed over and returned.
  • The salary used for insurance contributions is the contract salary, not partly split off into a "remote work allowance" to lower the contributions.
  • A permanent move to the head office only takes effect once you sign an appendix under Article 22.

If you are taking a remote job with a company in another province, look up the company's tax code before signing, because the entire interview process may have taken place on screen.

Common employer mistakes with remote work contracts

The most widespread is signing a "collaborator" contract with a full-time remote worker who has a direct manager, to avoid insurance; under Article 13 this is still an employment relationship, and the business has to pay the contributions owed. The second is having no equipment clause, so that only when the employee leaves does the business realise it has no basis for recovering the laptop and accounts. The third is calling employees back to the office by word of mouth and then disciplining them when they do not come, while the contract states that the place of work is their home.

Drafting a remote work contract on Việc Hot

  1. Choose the remote work template and the industry

IT, design and marketing are the three industries whose clauses on ownership of work and copyright suit remote work.

  2. Fill in both parties, the place of work and the equipment allowance

Enter the work address, attendance schedule, hours and allowance. Turn on "View by role" to read the notes for each side.

  3. Send the link for the employee to read, then print

The shared copy contains no internal notes. The contract is saved in your account and prints directly from the browser.

Frequently asked questions

Yes. Labour contracts of 1 full month or more are compulsorily covered regardless of where the work is done; contributions are calculated on the salary stated in the contract.

If the contract sets an attendance schedule, the company may require attendance in line with that schedule. To move the place of work permanently to the head office, an appendix signed by the employee is required.

The two sides agree on this and write the specific amount into the contract. The company may not require a deposit for equipment; handover and return should be recorded in writing.

Yes. Hours worked beyond those set in the contract, if requested or approved by the company, are overtime and are paid as the law requires.
