Part-time labour contracts: compulsory insurance and how entitlements are calculated

8 sectionsAbout 4 min readUpdated 01/10/2026

Waiting staff on evening shifts, a teaching assistant who works three sessions a week: all of them are non-full-time workers, usually called part-time. Many businesses have them sign a "collaboration agreement" to avoid paying insurance, and many part-timers believe they have no annual leave. Both are wrong. This article explains their entitlements under Article 32 of the Labour Code 2019 (Bộ luật Lao động 2019) and what a template for a part-time labour contract (hợp đồng lao động bán thời gian) must contain.

What part-time work means in law

Article 32 of the Labour Code 2019 calls this working non-full-time: the working time is shorter than the employer's normal working hours per day, week or month, measured against 8 hours a day and 48 hours a week under Article 105. The key point is that non-full-time workers receive pay, rights and obligations equal to those of full-time workers. Equal does not mean an identical amount of money; it means the same basis, prorated to the time actually worked. A 4-hour shift may not be paid a lower hourly rate than an 8-hour shift for the same work.

Does a part-time contract require insurance contributions?

Yes, if the contract lasts 1 full month or longer. The Social Insurance Law 2024 (Luật Bảo hiểm xã hội 2024), in force from 1 July 2025, makes people working under labour contracts of 1 full month or more compulsorily insured, regardless of how many hours they work each week. Contributions are calculated on the contract salary: the employee pays 8% for social insurance, 1.5% for health insurance and 1% for unemployment insurance; the employer pays 17.5%, 3% and 1%. The template on Việc Hot handles a situation that often causes disputes: in a month with 14 or more working days, the employer pays the insurance contributions; in a month with fewer, it pays the equivalent amount together with that month's salary so that the employee can enrol on their own, and the parties may not agree to drop this clause.

Mandatory clauses in a part-time labour contract

This is still a labour contract, so Article 21 applies in full: the parties, the job and place of work, the term, pay and pay period, working hours, insurance and labour protection. What differs is the working-hours clause: it must state the number of hours per day or per week and the time slots worked, because these are the basis for calculating pay, annual leave and insured working days, and for identifying overtime.

A working-hours clause written the right way

Article 3. The employee works 20 hours a week, from 17:30 to 21:30 on Mondays, Wednesdays and Fridays and from 08:00 to 16:00 on Saturdays, which is less than the employer's normal working time of 48 hours a week.

Hours worked beyond the schedule above are overtime, agreed by both parties in advance and paid at the statutory overtime rate. The employee receives pay, rights and obligations equal to those of full-time employees, calculated on the time actually worked.

A part-time contract also falls into one of the two types under Article 20: definite-term, up to 36 months, or indefinite-term; after two definite-term contracts, the third must be indefinite-term.

What employees should check before signing

  • The document is called a labour contract rather than a "collaboration agreement" if you clock in, wear a uniform and take instructions from a manager.
  • Your weekly hours and time slots are stated clearly; shift changes require advance notice.
  • The hourly rate is not below the regional hourly minimum wage; overtime, night work and public holidays are paid at their own rates.
  • There is an insurance clause for contracts of 1 full month or more, and it says how months with too few working days are handled.
  • Nobody keeps your ID card or diploma or asks you for a "uniform deposit", all of which Article 17 prohibits.

To see your take-home pay after the 10.5% insurance deduction and tax, enter your hourly rate multiplied by your expected hours in the gross to net salary calculator; for hours beyond your schedule, use the overtime pay calculator.

Common employer mistakes when hiring part-time staff

The most serious is signing a "collaborator contract" with someone who works shifts under direct supervision. Article 13 provides that an agreement, whatever it is called, is a labour contract if it involves pay together with management, direction and supervision; after an inspection or a complaint, the business has to pay the insurance contributions owed for the entire period. The second is writing the pay as "agreed per shift" with no hourly rate and no number of hours, so overtime cannot be calculated. The third is removing part-timers' annual leave and public holidays altogether, contrary to Article 32. If what you really need is to hire someone per task, with no timekeeping and no direction, use the proper collaborator contract template.

Drafting a part-time labour contract on Việc Hot

  1. Choose the part-time template and the industry

Hospitality adds clauses on shifts, public holidays and service charges; education adds professional certificates and teaching materials.

  2. Fill in both parties, the hours and the rate

Enter the business and employee details, the work schedule and the pay. The editor warns you if the pay is below the regional minimum wage.

  3. Print or save, and share the link

The printed copy contains no notes; the contract is saved in your account and can be sent to the employee to read in advance.

Frequently asked questions

Yes. Article 32 gives non-full-time workers equal rights, so annual leave is prorated to working time rather than removed altogether.

It is not compulsory; contributions are required only from 1 full month. A contract of less than 1 month may be made verbally under Article 14, but it is better to put it in writing so there is a basis for paying wages.

Yes, if the job involves timekeeping, someone directing the work and hourly pay. Calling it a "collaborator" role does not change the nature of the employment relationship under Article 13.

The parties may choose, provided the hourly rate is not below the regional hourly minimum wage and the contract states the standard hours so that overtime can be calculated.
