Hiring a domestic worker: which contract to sign and how the insurance amount is paid

8 sectionsAbout 4 min readUpdated 01/10/2026

Families who hire a domestic worker to look after the children or care for the grandparents usually agree everything verbally. The Labour Code 2019 (Bộ luật Lao động 2019), however, treats this as an employment relationship with its own rules in Articles 161 to 165: the contract must be in writing, and together with the salary the family pays an amount equal to the social insurance and health insurance contributions so that the worker can pay them personally. This article guides householders and domestic workers through the domestic worker contract (hợp đồng giúp việc gia đình) template.

Domestic work is an employment relationship, not a private household matter

The Labour Code 2019 devotes a whole section to domestic workers: people who regularly do household work such as housekeeping, caring for children, elderly people or sick people, driving or gardening for one or more households, unconnected with any business the household runs. The employer here is a household or an individual, so the party signing the contract is the householder, and no seal is needed.

The first difference from an ordinary contract: Article 14 allows contracts of less than 1 month to be made verbally, but domestic work is one of the exceptions that must be in writing even for a short term. Decree 145/2020/ND-CP has a separate part guiding this group of workers.

Pay, the insurance amount paid with wages, and board and lodging

Pay may not be lower than the regional minimum wage where the family lives. From 1 January 2026, under Decree 293/2025/ND-CP, it is 5,310,000 VND a month in Region I, 4,730,000 VND in Region II, 4,140,000 VND in Region III and 3,700,000 VND in Region IV. The householder does not pay insurance contributions directly for the domestic worker, but pays, together with the salary, an extra amount equal to the statutory social insurance and health insurance contributions so that the worker can enrol personally; the two sides should write the exact amount into the contract rather than the phrase "as prescribed by law".

ItemWho paysHow to write it in the contract
Monthly salaryWho paysHouseholderHow to write it in the contractThe amount and payday, not below the regional minimum wage
Amount equal to social and health insurance contributionsWho paysHouseholder, paid on top of the salary in the same pay periodHow to write it in the contractState it as a separate figure, not folded into a phrase such as "salary already includes"
Meals and accommodation for a live-in workerWho paysHouseholder, if agreedHow to write it in the contractState what the householder covers; deductions are allowed only if the deduction amount is written in
Pay for working on public holidays or TetWho paysHouseholderHow to write it in the contractUnder the rules on working on public holidays
Tet bonus, giftsWho paysBy agreementHow to write it in the contractWrite it in if it is meant to be an obligation; if it is not written in, it is at the family's discretion

Working hours and rest for workers living in the employer's home

Live-in domestic workers can easily end up working from the moment the family wakes up until everyone goes to bed. The template sets minimum rest: at least 8 hours a day, including 6 consecutive hours, and at least 24 consecutive hours a week. Public holidays, Tet and 12 working days of annual leave after 12 full months of work under Article 113 still apply.

A working-hours clause written the right way

Article 3. Working hours and rest periods

The employee works from 06:30 to 20:30 each day, with a midday break from 13:00 to 15:00. Each day the employee has at least 8 hours of rest, including 6 consecutive hours from 22:00 to 04:00 the following morning.

The employee has every Sunday off in full. The two parties may move this to another day of the week by agreeing at least 2 days in advance.

Clauses a domestic worker contract needs

The duties should be listed specifically: cooking three meals for four people, cleaning a three-storey house, taking a child in Grade 2 to and from school, and exactly what caring for an elderly woman of 80 involves. The contract also needs the place of work, the term, pay, the insurance amount, board and lodging, how the worker is to be treated, the duty to keep the family's private affairs confidential, and the notice period for termination. The template states that either side may terminate unilaterally with at least 15 days' notice under the specific rules for domestic workers.

What domestic workers should check before signing

  • The contract states the householder's name, ID card number and address, matching the place where you will live and work.
  • Your duties are clearly listed; caring for someone seriously ill or minding another family's children, if not on the list, counts as extra work.
  • The salary states the amount and payday; the insurance-equivalent amount is stated separately and paid with the salary.
  • The weekly day off, daily rest hours and accommodation are spelled out.
  • You keep a copy signed by the householder, and nobody keeps your ID card.

Common householder mistakes when hiring a domestic worker

The most common is signing nothing at all, so that when property goes missing or the worker walks out without notice, there is nothing to rely on. The second is paying 7 million VND "including insurance" without separating the insurance-equivalent amount into its own figure, so in a dispute it is treated as unpaid. The third is deducting board and lodging from pay even though the contract states no deduction amount. The fourth is giving no weekly day off on the grounds that "you're at home all day, so what do you need a day off for". The last is dismissing the worker the same day out of dissatisfaction, ignoring the notice period and the payments due on termination.

Drafting a domestic worker contract on Việc Hot

  1. Choose the domestic worker template

The template is for households, so the hiring party only needs a full name, ID card and address; no tax code or seal is required. You can skip the industry step.

  2. Fill in the duties, hours, pay and insurance amount

Enter the list of duties, the working hours, the salary and the extra insurance amount. The editor warns you if the pay is below the regional minimum wage.

  3. Print two copies, one for each side

The printed copy contains no notes. The householder can save the contract in their account to reuse when hiring someone new.

Frequently asked questions

Not directly. Together with the salary, the householder pays an extra amount equal to the social insurance and health insurance contributions so that the worker can enrol personally. The exact amount should be written in the contract.
